Marketing and Promotional Communications

If you have opted in to receive marketing communications from us, we may use your email address to send you information about new product arrivals, promotions, or other updates related to our JDM engine and transmission inventory. You may opt out of marketing emails at any time by clicking the "unsubscribe" link in any marketing email we send or by contacting us directly at jdmflorida@gmail.com. Opting out of marketing communications does not affect transactional emails related to your orders.

3. How We Share Your Personal Information

JDM Florida does not sell your personal information to third parties. We do not trade, rent, or share your data with advertisers or data brokers for their own independent marketing purposes. We share your personal information only in the specific, limited circumstances described below.

Payment Processors

When you place an order on https://jdmflorida.com/, your payment details are processed by our third-party payment processor. This service provider receives the billing and payment information necessary to authorize and complete your transaction. Our payment processor operates under its own privacy policy and is bound by the standards of the Payment Card Industry Data Security Standard (PCI DSS). We do not retain your full card number or CVV on our servers.

Freight and Shipping Carriers

In order to ship your purchased products—which may include heavy used JDM engines, transmissions, complete swap kits, or other automotive components—we share your name, shipping address, and phone number with our freight and LTL (Less-Than-Truckload) shipping carrier partners. These carriers use this information solely to deliver your order and to contact you regarding delivery scheduling or issues.

Website Hosting and Technology Providers

Our website is built on the Laravel PHP framework and is hosted by a third-party web hosting provider. Our hosting provider has access to the technical infrastructure on which our website and its associated database operates. We select hosting providers that maintain appropriate data security standards and are contractually obligated to protect your information.

Analytics Providers

We use third-party analytics services, including Google Analytics, to collect and analyze website usage data in aggregated and anonymized forms. These services may set their own cookies and collect data about your browsing behavior on our website. You can opt out of Google Analytics data collection by installing the Google Analytics Opt-Out Browser Add-on at https://tools.google.com/dlpage/gaoptout.

Advertising Partners

If we run advertising campaigns through platforms such as Google Ads or Meta (Facebook and Instagram), those platforms may receive data through pixels or tracking tags placed on our website. This data is used to measure ad performance and, where applicable, to serve you relevant advertisements. These platforms operate under their own privacy policies.

Legal Authorities and Law Enforcement

We may disclose your personal information to government agencies, law enforcement authorities, courts, or other legal bodies if we are required to do so by applicable law, regulation, legal process, or enforceable government request. We may also disclose information where we believe in good faith that disclosure is necessary to protect the rights, property, or safety of JDM Florida, our customers, or the public.

Business Transfers

If JDM Florida or JDM TECH LLC is involved in a merger, acquisition, asset sale, or other business transition, your personal information may be transferred as part of that transaction. In such a case, we will notify you before your personal information is transferred and becomes subject to a different privacy policy.

4. Data Retention

We retain your personal information for as long as is necessary to fulfill the purposes for which it was collected, as described in this Privacy Policy, or as required by applicable law. The following general retention guidelines apply:

Order Records: We retain records of your completed purchases, including order details, billing information, shipping information, and payment confirmation, for a minimum of seven years from the date of the transaction. This retention period is required for tax recordkeeping purposes under U.S. federal and state tax law and to support any warranty claims, return requests, or legal matters that may arise.

Account Information: If you maintain an active customer account with us, we retain your account information for as long as your account remains open. If you request deletion of your account, we will delete your account information within a reasonable time, subject to any legal retention obligations we are required to fulfill.

Customer Support and Warranty Correspondence: Records of customer support inquiries, warranty claims, and related correspondence, including mechanic reports and product photographs submitted with warranty claims, are retained for a minimum of three years from the date of the inquiry or claim.

Analytics and Log Data: Website log files and anonymized analytics data are typically retained for up to 24 months, after which they are deleted or permanently anonymized.

Marketing Communication Records: Records of your email marketing consent and opt-out requests are retained for as long as is necessary to demonstrate compliance with applicable anti-spam and marketing laws.

When personal information is no longer required for the purpose for which it was collected and no legal retention obligation applies, we will securely delete or permanently anonymize it.

5. Data Security

JDM Florida takes the security of your personal information seriously. We implement a range of technical and organizational measures designed to protect your personal data from unauthorized access, disclosure, alteration, loss, or destruction. These measures include:

Encryption: All data transmitted between your browser and our website is encrypted using SSL (Secure Sockets Layer) / TLS (Transport Layer Security) technology. You can verify this by checking for the padlock icon and the "https://" prefix in your browser's address bar when visiting our website.

CSRF Protection: Our Laravel-based website employs built-in Cross-Site Request Forgery (CSRF) protection, which prevents unauthorized parties from submitting malicious requests on your behalf while you are logged in to your account.

Password Security: Customer passwords are stored using industry-standard cryptographic hashing. We never store your password in plain text, and our staff cannot view or retrieve your password.

Payment Data Security: We do not store your full payment card number, CVV security code, or card expiration date on our servers. All payment data is handled directly by our PCI DSS-compliant payment processor.

Access Controls: Access to customer data stored in our systems is restricted to authorized JDM Florida staff members who require access to fulfill their job responsibilities.

Session Security: Our website uses secure, encrypted session management through Laravel's built-in session system, which protects your active login session from hijacking or unauthorized access.

Please understand that no method of data transmission or storage over the internet is completely and unconditionally secure. While we work diligently to protect your personal information, we cannot guarantee that unauthorized third parties will never find a way to defeat our security measures. If you have reason to believe that your interaction with our website is no longer secure, please contact us immediately at jdmflorida@gmail.com.

6. Children's Privacy

Our website, https://jdmflorida.com/, and the products we sell — including used JDM car engines, transmissions, and automotive accessories — are intended for adults. Our products are typically purchased by mechanics, auto shop owners, automotive enthusiasts, and vehicle owners who are adults capable of entering into legally binding contracts.

We do not knowingly collect personal information from children under the age of 13. Our website is not designed or intended to attract children, and we do not target any of our marketing communications at children.

If you are a parent or legal guardian and you believe that your child under the age of 13 has provided us with personal information without your consent, please contact us immediately at jdmflorida@gmail.com or +1 (407) 774-8324. We will promptly investigate the matter and, if confirmed, delete the child's personal information from our records without delay.

Our handling of children's data is governed by the Children's Online Privacy Protection Act (COPPA) (15 U.S.C. § 6501 et seq.), which prohibits the collection of personal information from children under 13 without verifiable parental consent.

7. Cookies and Do Not Track

For a complete explanation of the cookies and tracking technologies we use on https://jdmflorida.com/, including specific cookie names, their purposes, their duration, and how to manage or disable them, please read our full Cookie Policy.

Regarding Do Not Track (DNT) signals: Some web browsers allow you to enable a DNT setting that sends a signal to websites requesting that your browsing not be tracked. There is currently no legally binding or consistently recognized standard in the United States for how websites must respond to DNT signals. As a result, our website does not currently alter its data collection or tracking practices in response to DNT signals received from your browser. You may manage your tracking and cookie preferences directly through our cookie consent tools or your browser settings as described in our cookie policy.

8. Third-Party Websites and Links

Our website may contain links to third-party websites, including websites of automotive information resources, vehicle compatibility databases, freight carriers, or other businesses. This Privacy Policy applies only to https://jdmflorida.com/ and does not govern the data collection or privacy practices of any third-party website.

When you follow a link from our website to a third-party website, that website's own privacy policy will apply to your interaction with it. JDM Florida has no control over the privacy practices of third-party websites and accepts no responsibility for how they collect, use, or protect your personal information. We encourage you to review the privacy policy of any third-party website you visit before providing any personal information.

9. Your Privacy Rights by U.S. State

The United States does not currently have a single comprehensive federal privacy law that grants uniform rights to all consumers in all states. However, a growing number of U.S. states have enacted their own consumer privacy legislation that gives residents specific rights regarding their personal information. This section explains your rights based on your state of residence. Regardless of your state, you may always contact us at jdmflorida@gmail.com to make a privacy request.

9.1 California Residents — CCPA and CPRA

California residents have the most robust set of consumer privacy rights in the United States under the California Consumer Privacy Act (CCPA) (California Civil Code Section 1798.100 et seq.), as amended and expanded by the California Privacy Rights Act (CPRA), effective January 1, 2023.

Under these laws, California residents have the following rights:

Right to Know: You have the right to request that we disclose the categories of personal information we have collected about you, the categories of sources from which we collected it, the business or commercial purposes for which we use it, the categories of third parties with whom we share it, and the specific pieces of personal information we have collected about you.

Right to Delete: You have the right to request that we delete personal information we have collected about you, subject to certain exceptions. For example, we may be required to retain certain information to complete a transaction, comply with a legal obligation, or detect security incidents.

Right to Correct: You have the right to request that we correct inaccurate personal information we hold about you.

Right to Opt Out of Sale or Sharing: You have the right to opt out of the sale of your personal information and the sharing of your personal information for cross-context behavioral advertising. JDM Florida does not sell personal information as that term is conventionally understood. However, the use of advertising cookies and pixels may constitute "sharing" under the CPRA. To opt out, please visit our dedicated page: https://jdmflorida.com/dont-sell-or-share-my-personal-information.

Right to Limit Use of Sensitive Personal Information: You have the right to direct us to limit the use of sensitive personal information to what is necessary to perform the services you requested.

Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA or CPRA rights. We will not deny you goods or services, charge you different prices, provide a different level of quality, or retaliate against you in any way for exercising your privacy rights.

Categories of Personal Information Collected in the Last 12 Months:

Under California law, we disclose the following categories of personal information we have collected, the source of that information, the purpose for which it was collected, and with whom it was shared:

Category A — Identifiers: Full name, email address, phone number, billing address, shipping address, IP address, and account login credentials. Collected from you directly and automatically from your device. Used to process orders, manage your account, provide customer support, and prevent fraud. Shared with our payment processor and freight carriers.

Category B — Customer Records (California Civil Code Section 1798.80(e)): Name, address, telephone number, and payment card information (last four digits only, retained by processor). Collected from you at checkout. Used to fulfill your order. Shared with our payment processor.

Category D — Commercial Information: Records of products you have purchased, browsed, added to your wishlist, or compared, including used JDM engines, transmissions, front clips, and automotive accessories. Collected from your interactions with our website. Used to fulfill orders, provide support, and improve our product offerings.

Category F — Internet or Other Electronic Network Activity Information: Browsing history on our website, search queries, pages visited, products viewed, and cart interactions. Collected automatically. Used for analytics and website improvement.

Category G — Geolocation Data: Approximate location derived from your IP address. Collected automatically. Used for analytics and to determine applicable sales tax.

We have not knowingly collected, sold, or shared personal information from consumers under the age of 16.

To submit a CCPA/CPRA request, please contact us at jdmflorida@gmail.com or +1 (407) 774-8324. We will verify your identity before processing your request and will respond within 45 calendar days of receiving a verifiable consumer request, with a one-time extension of an additional 45 days where reasonably necessary, with prior notice to you.
